Supreme Court Rules Against File Swapping

America's top judges have found against Grokster and StreamCast, ruling that peer-to-peer services can be held responsible for copyright infringements committed by their users.

In a unanimous decision, the justices ruled companies that build businesses with the active intent of encouraging copyright infringement should be held liable for their customers' illegal actions.

It won't immediately shut down access to the trading networks, however. The court's ruling will send the case back to the lower courts, which will review the evidence against Grokster and co-defendant StreamCast in the light of Monday's decision.

"The most important message from today's historic decision is that progress and innovation do not have to come at the expense of recording artists, songwriters and the people who make their living in the entertainment industry," Warner Music Group chief executive Edgar Bronfman said in a statement. "This important decision will allow artists and the creative community to prosper side by side with the technology industry."

The peer-to-peer companies involved warned that the court had opened the floodgates to litigation against a wide variety of technology companies, but said they would continue to distribute their software, and expected to be cleared of any wrongdoing.

"We are confident that it will be proven that Morpheus does not promote or encourage copyright infringement," said StreamCast Chief Executive Officer Michael Weiss. "We're staying in this for the fight. We're going to continue to innovate and come out with new products."

Four generations of file swapping have laid the groundwork for the Supreme Court decision. Technology companies have feared that a new copyright-focused standard aimed at controlling peer-to-peer networks might result in a rise in lawsuits aimed at blocking new products. The Betamax ruling had protected generations of products, ranging from CD burners to Apple's iPod to personal computers.

Some in the technology world said the result could lead to more litigation against young companies with new technologies.

"This is a very dangerous decision for technology and innovation," said Ed Black, chief executive officer of the Computer and Communications Industry Association. "If you think of the Sony decision as a shield or an umbrella, we're afraid some holes have been punctured in that umbrella."

Michael Petricone, vice president of technology policy for the Consumer Electronics Association, added that "it is a real concern for entire industry. We are faced with competitors in China and India who do not face the same litigation burden that companies will with this decision."

We lost but the fight goes on. Time for p2p and BitTorrent to come together.

A Great Loss

It is with immense regret and sorrow that I inform you that Richard Whiteley, presenter of Countdown for 23 years has died this evening aged 61. It is a great loss to the gameshow community and our most sincere condolences go out to all his friends and family.

Overclocked Overlooked

So you probably all know about Overclocked Remix. One of the biggest sites on the net owned by a contender for biggest ego on the net (he's allowed). Spawning spin-offs like Ormgas and pisstakes like Overlooked Remix (www.olremix.org) its hard to remember where it started.

The original Overclocked webcomic. All 145 episodes remain on that small, badly designed site. It looks quite different to the modern OCR doesn't it? In my opinion OCR lost its charm when the shabby blue design went. Anyway, check out Overclocked if you've ever dabbled in emulation. Its hilarious.

Oh, and if you've read it before bear in mind that some episodes have been brought up to date such as Episode 9 - Doubts. Pretty accurate I reckon.

Guilty Pleasures

We all have them. Stuff we really shouldn't like, stuff we don't want to like but we like it anyway. Case in point for me? A band with a ridiculous symbol, stupid name and a frontman who looks suspiciously like Bam Margera.

My sister likes them and that's where the problems started. Initially I hated them and communicated that face nice and clearly but they've grown on me and I'm starting to like them. For me, that's a problem.

Watching series 1 of Casino Casino I'm trying to work out who chopped the balls off the series 2 players. Series 1 players were making bets of 6000 on the first hand of blackjack and putting 500 bets on single numbers at the roulette table. They were also risking the lot in the manager's office bets. Not just if they had a paltry 4000 left but even with a massive stack of 88000. Series 2 and players stuck to the minimum of 1000 on blackjack and barely went above 20000 in the manager's office. no guts no glory guys.

My PokerRoom.com balance is looking up. Around $2,200 going into today's session and I left with $2,800.

Currently I've watched 75 minutes of the original Cardcaptor Sakura and can't believe how much was cut and edited in the metamorphasis from CCS to Cardcaptors. Both arrive at the same location but take completely different paths to get there.

The Battle of eBay

Bob Geldof and Live8 vs eBay and the Ticket Touts

I am easily on the side of ebay and the touts. Geldof has tried to bully ebay into taking down the sales and even gone as far as encouraging hackers to attack the site. These tickets were being given away free and no money is being taken away from charity. I believe that by taking down the ticket sales ebay has yielded to threats and is stifling the free market Geldof has campaigned for.

Its not good having something like this on the verge of ebay's 10th birthday.

Balls Dropping At 3.5G

I got some photos from my trip today. I didn't get to do as much as I wanted as we didn't get there as early as we expected. I did 3 rides including 2 of the big 4. The big 4 are in case you didn't know Oblivion, Air, Rita and the almighty Nemesis.

Ride 1 - Spinball Whizzer
Nice one to start with. So I thought. This fucker absolutely flings the cars around the track which includes a climb and drop that rival Oblivion's drop. That and the cars are constantly spinning all the way round. Brilliantly designed and a lot of fun.

Ride 2 - Oblivion
Scary. After a 20 minute wait in line I eventually put my mp3 player on to calm down. The in-queue entertainment didn't help, 2 guys arguing over the safety of the ride "haven't you heard the screams?!". Eventually we reached the point of no return and some dickweed's camera caused our car to stall halfway up the climb. Not helping but eventually we got to the top and that now legendary pause just before the drop. Only one way from there.

Coming out the tunnel I let off a massive shout.
"YES! YES! FUCK YES!"

After that I got lumbered with the pushchair for Hex and Nemesis. I know you're meant to ride it, not sleep with it but with the glorious curves of Air in the background all I could think of was my god Nemesis is an ugly fucking ride. We looked in on Rita and didn't see it moving that fast. In fact it wasn't moving at all, it broke down.

Ride 3 - Air
Queue Time From This Point - 100 Minutes
Interesting tactic by the clearly knackered staff. The queue was not 100 minutes long. After queueing for 30 minutes (if that) we were in the station. Pretty cool affair. Neon blue signs indicating the 7 gates like some kind of futuristic airport. We boarded (not at the front unfortunately) and with the words "assume the position" we rose into the ride position which you probably know. I have never enjoyed any ride as much as I enjoyed that. 60 seconds of pure adrenaline driven fun. The drops and corkscrews don't have the same terrifying effect as Nemesis due to the fact that you're lying down. Its a brilliant feeling.

I grabbed a keyring on my way out through the shop.

I'm going back again in 3 weeks for my sister's birthday so then I'll do Rita, Nemesis and Air (again).

Doctor Who this week saw the Doctor, Rose, Jack and the TARDIS were forcibly dragged back to Satellite 5. 100 years after the destruction of the Jagrafess and the Editor the satellite is now under ownership of the Badwolf Corporation. It has become a mass TV studio broadcasting amongst others shows like Big Brother, The Weakest Link and What Not to Wear. However contestants in these games don't win money or fame for their victory but walk away with their life. As the Doctor and Jack escape Rose loses and is killed by the Anne-droid (oh dear). The Doctor and Jack alongside Big Brother housemate Lynda attack floor 500 where they find out the true fate of the failed contestants. On the edge of the solar system an army is gathering and recruiting the failed contestants ready for a final assault on Earth. The Daleks are back for one last dance...

Doctor Who is repeated on BBC3 tomorrow at 12:10am and 7pm. Part 2 of this episode is on next Saturday at 7pm on BBC1.

COME ON!! 2 points off the lead after the first scoring week. Here's where my points came from.

Maxwell nailed a good 3 point bonus for a good Celebdaq showing but lost a point for his underwear burning antics which put him on the naughty step. He also lost a point for getting a nomination.

Science did not have a good week. Chosen as the league's unlucky housemate so he didn't get any positive bonus' and had nomination penalties doubled. His single nomination cost him 2 and he also lost a single for failing the task.

Derek lost a whopping 7 for taking a bashing in the nominations.

I've got this strange feeling. I have no idea what it is though, I've never felt it before and I don't know what to do. Its like I want to be angry but I can't. Its like something's changed but I don't know what.

Its Not My Fault You Suck

Penny Arcade is swords drawn with Scott Kurtz and Scott McCloud. Again. For those who don't know the 2 Scott's have waged war against Mike and Gerry for some time. Basically it comes down to a few basic facts.

a) The Scott's don't make good comics (PvP for Kurtz and User Friendly for McCloud) while the PA boys do.

b) The Scott's are assholes. I can't say that Mike and Gerry aren't but they're slightly smaller assholes.

c) The Scott's are ugly. OK point conceded that the PA boys are uglier.

The fact remains that this isn't an issue that's gonna be resolved any time soon. Please don't discriminate against webcomic authors named Scott though. Scott Ramsoonair owns VG Cats after all.

I hate it when my comp crashes. Its not usually a problem but when chatting to someone sensitive to sudden disappearances its a real pain in the ass.

On April 14th 2005 I started a download. The 2.3gb download of all 13 episodes of the anime Air. Now, nearly 2 months later it has finally hit 100% completion. I'll watch it after Yumeria which is verging on the ecchi side of things with the transformation scenes.

U2 - City of Blinding Lights

I set a new film record for myself this week. Not counting multiple seeings or films I'd seen before the most films I'd seen in a week was 2 before. Now having rattled through Princess Mononoke (3 times), Revenge of the Sith (once) and Dodgeball (twice) in a single week the record has gone. I'm happy to say all 3 were awesome films. Big Brother, Bigger Ego

Nick Gates aka Brig Bother owns one of the best websites on the net. Bother's Bar is a great website for the casual gameshow fan far from the anorak approach of UKGS. Thing is, Brig's ego has somewhat inflated along with David Bodycoumbe's (as it that one wasn't big enough already).

This morning Brig appeared on T4. He was promoting the Fantasy Big Brother League.

Last night David appeared on Channel 4's The Ultimate Gameshow.

I am playing aforementioned NFS:U and liking it, especially once I saw the makeover that had been given to Atlantica.

I'm also still laughing having left my brother stunned after a crucial last mini-game victory in Mario Party 5.

I watched Princess Mononoke last night so expect a review very soon. It's only reached about #1 in my best films ever list.

I've watched 7/13 episodes of Stratos 4 and things are really starting to pick up.

I'm going to see Episode 3 later. It will probably not have the same effect as one of the films I've seen in the last 24 hours (I've only watched 1 film in the last 24 hours).

I finally got a 7-day trial subscription over at dA. Haven't got everything working yet though.
